These Terms of Business set out the basis on which FLBF Ltd, trading as Maximise Finance ("we", "us", "the Company"), provides business finance introduction services. By engaging with us, submitting an enquiry, or accepting an introduction, you agree to these terms.
1. Who we are and our regulatory status
FLBF Ltd, trading as Maximise Finance, is a company registered in England and Wales, company number 16575453, registered office 67 Sycamore Grove, Failsworth, Manchester, England, M35 9NB.
We are not authorised or regulated by the Financial Conduct Authority (FCA). We introduce and arrange business finance exclusively for limited companies. Loans to limited companies do not constitute regulated credit agreements under the Consumer Credit Act 1974, and this activity therefore falls outside the scope of FCA regulation. We do not provide finance introductions to sole traders, partnerships, or individuals.
2. Our services
We act as an introducer/broker, connecting limited companies seeking business finance with a panel of lenders. Our role is to facilitate introductions; we do not lend funds ourselves, and we do not provide regulated financial advice.
We do not guarantee that any introduction will result in an offer of finance, or that terms offered by a lender will be the most competitive available in the market. Final lending decisions, and all terms of any facility, are made solely by the relevant lender.
3. No advice
Nothing we provide constitutes financial, legal, tax, or professional advice. Businesses should seek their own independent advice before entering into any finance agreement.
4. How we are paid
We may receive commission or a fee from lenders for successful introductions. The existence and, where applicable, the amount of commission will be disclosed to you on request and, where required, before you proceed with a lender. Working with a lender that pays us a higher rate of commission does not influence our decision to introduce you to them over a lender paying less, and we aim to act reasonably in matching businesses with suitable lenders on our panel.
5. Your obligations
- Provide accurate, complete, and up-to-date information about your business and its finance requirements
- Notify us promptly of any material change to the information provided
- Deal directly with the lender once an introduction is made in respect of the specific finance agreement, its terms, and its performance
6. Data protection
We will process personal data in accordance with our Privacy Policy, available on this website. By using our services you acknowledge that relevant information may be shared with lenders for the purpose of assessing and progressing a finance introduction.
7. Liability
We will use reasonable care and skill in providing our introduction services. To the fullest extent permitted by law, we exclude liability for any loss arising from the acts, omissions, or terms offered by any lender, and for any indirect or consequential loss. Nothing in these terms excludes liability for death or personal injury caused by negligence, or for fraud.
8. Complaints
If you are unhappy with our service, please refer to our Complaints Procedure, available on this website. As we are not FCA-regulated, complaints about our introduction service are not eligible for referral to the Financial Ombudsman Service; complaints about the terms or conduct of a specific lender should be directed to that lender in the first instance.
9. Termination
Either party may end the relationship at any time by written notice. Termination does not affect any rights or obligations that have already accrued, including in relation to commission on introductions already made.
10. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction over any dispute.
